Please become familiar with it and take the time to read this waiver consciously. 

WOMBANKIND FESTIVAL 2025 – PARTICIPANT WAIVER AND RELEASE OF LIABILITY

This Waiver and Release of Liability ('Waiver') is entered into by the undersigned participant ('Participant') in relation to their attendance at and participation in the Wombankind Festival 2025 ('Event') held in Queensland, Australia.

By signing this Waiver, the Participant acknowledges, understands, and agrees to the following:

1. ASSUMPTION OF RISK

Parents and guardians bringing babies or children to the Event acknowledge that they are solely responsible for the safety, supervision, and well-being of their child(ren) at all times. The Event Organisers, staff, volunteers, facilitators, and associated parties accept no responsibility or liability for any injury, illness, harm, loss, or accident involving a child during the Event.

Parents and guardians must ensure their children are supervised and adhere to all festival rules, including those related to safety, noise levels, and respect for other participants. The Event is held in a natural environment, and there may be risks including but not limited to wildlife, uneven terrain, water hazards, extreme weather, and other festival-related activities.

The Event Organisers shall not be held liable for any incident involving a child, and by attending, parents and guardians expressly assume all risks associated with bringing their children to the Event.

 

Participants acknowledge that the Event is held in a natural environment where they may be exposed to risks including uneven terrain, limited access to immediate medical assistance, and exposure to natural elements such as extreme temperatures, wildlife, and insects. Camping areas must be maintained in a safe and respectful manner, and all participants agree to follow fire safety protocols, including only using designated fire areas and adhering to any fire bans or restrictions.

 

Participants acknowledge the potential for emotional or psychological distress, including the surfacing of past trauma, due to participation in activities such as workshops, discussions, healing practices, or other immersive experiences. Participants understand they are responsible for their own emotional well-being and should seek appropriate support if needed.

The Event Organisers and facilitators are not licensed medical or psychological professionals. This event is not a substitute for professional mental health or medical advice. If you have concerns regarding your emotional or psychological well-being, we strongly recommend consulting a qualified professional before participating.

Participants engaging in high-intensity physical, breathwork, or alternative healing activities do so at their own risk and should consult a medical professional if they have any concerns.

 

Participants acknowledge the potential for emotional or psychological distress, including the surfacing of past trauma, due to participation in activities such as workshops, discussions, healing practices, or other immersive experiences.

 

Participants understand they are responsible for their own emotional well-being and should seek appropriate support if needed.

 

The Participant acknowledges that attending and participating in the Event involves inherent risks, including but not limited to:
- Physical injury, illness, or medical conditions (including but not limited to dehydration, heat exhaustion, allergic reactions, or any other health complications).
- Risks associated with outdoor environments, including exposure to wildlife, uneven terrain, weather conditions, and natural hazards.
- Potential injury due to participation in workshops, movement-based activities (such as yoga, dance, or meditation), and interactions with festival structures, equipment, or other participants.
- The risk of contracting illnesses, including communicable diseases such as COVID-19.
The Participant voluntarily assumes all risks associated with their participation and acknowledges that the organisers, staff, volunteers, vendors, and any associated parties ('Event Organisers') are not responsible for any injury, loss, damage, or harm that may occur.

2. RELEASE OF LIABILITY AND INDEMNIFICATION

To the maximum extent permitted by law, the Participant understands and agrees that this waiver does not exclude liability where such exclusion is not permitted under Australian Consumer Law (ACL) or Queensland's Civil Liability Act 2003. While the Event Organisers seek to limit liability, they do not waive responsibility in cases of gross negligence, unlawful conduct, or reckless disregard for participant safety.

By signing this waiver, the Participant confirms they have had the opportunity to read and understand the terms before participation. If signing electronically, the act of checking the consent box or proceeding with ticket purchase constitutes full acceptance of these terms.

To the maximum extent permitted by law, the Participant expressly releases, waives, discharges, and agrees not to hold liable the Event Organisers, including but not limited to the event hosts, organisers, employees, volunteers, facilitators, guest speakers, contractors, vendors, sponsors, landowners, and any associated parties ('Released Parties') for any and all claims, liabilities, damages, costs, or legal actions arising out of, or in any way connected to, participation in the Event.

This Waiver applies to all individuals involved in the Event, including but not limited to:
- General attendees and ticket holders
- Facilitators, workshop leaders, and performers
- Guest speakers and panellists
- Volunteers, event crew, and staff members
- Vendors, stallholders, and contractors

This release applies regardless of the cause, including but not limited to:
- Negligence, breach of duty, errors, or omissions by the Released Parties.
- Accidents, injuries, or fatalities occurring at the Event venue or in transit to/from the Event.
- Loss, theft, or damage to personal property.
- Exposure to infectious diseases, including COVID-19 and other communicable illnesses.
- Environmental hazards, such as extreme weather, wildlife, or venue conditions.
- Acts of third parties, including other participants, vendors, or attendees.
- Force majeure events, including but not limited to acts of nature, government actions, or unforeseen circumstances.

Furthermore, the Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, legal proceedings, or demands brought by the Participant or any third party as a result of their participation in the Event.

The Participant acknowledges that they voluntarily assume all risks and understands that by signing this waiver, they are giving up any legal rights to seek compensation or damages from the Released Parties under any circumstances, except in cases of gross negligence or wilful misconduct.

This agreement is binding upon the Participant, their heirs, assigns, legal representatives, and next of kin and shall be governed by the laws of Queensland, Australia.

3. MEDICAL CONSENT

The Participant acknowledges and agrees that:
- They are responsible for their own health and well-being and will take appropriate precautions while participating.
- They will inform the Event Organisers of any pre-existing medical conditions that may impact their ability to safely participate.
- In the event of a medical emergency, the Event Organisers have the right to seek medical assistance on the Participant’s behalf. Any costs incurred for medical treatment, ambulance services, or hospitalisation are the sole responsibility of the Participant.

4. PERSONAL PROPERTY

The Participant acknowledges that they are solely responsible for their personal belongings while attending the Event. The Event Organisers are not liable for any lost, stolen, or damaged items.

5. BEHAVIOUR AND COMPLIANCE WITH FESTIVAL RULES

The Event promotes a safe and mindful space. Participants agree to act responsibly and respect others' experiences. Excessive intoxication, possession or use of illegal substances, or disruptive behaviour due to substance use will not be tolerated. The Event Organisers reserve the right to remove any participant engaging in such conduct without refund or compensation.

The Event is committed to creating a safe, respectful, and inclusive environment. Participants agree to maintain a space free from discrimination, harassment, or inappropriate behaviour. Any form of harassment, including but not limited to verbal abuse, intimidation, sexual harassment, or discrimination based on race, gender, sexuality, or identity, will not be tolerated. The Event Organisers reserve the right to remove any individual engaging in such behaviour without refund or compensation.

Participants acknowledge that failure to comply with festival rules, security instructions, or health and safety protocols may result in removal from the event without refund or compensation. Any unlawful behaviour or violations of state or federal laws may be reported to authorities, and the Event Organisers reserve the right to take legal action against any individual causing harm, disturbance, or risk to others.

The Participant agrees to comply with all festival rules, policies, and guidelines, including but not limited to:
- Respecting all persons, property, and wildlife within the Event premises.
- Following instructions from festival staff, security personnel, and emergency responders.
- Abstaining from illegal substances and prohibited activities.
- Complying with all applicable laws and regulations in Queensland, Australia.

Failure to adhere to these terms may result in removal from the Event without refund or compensation.

 

6. MEDIA CONSENT

The Participant grants permission to the Event Organisers to photograph, film, or record them during the Event for promotional, marketing, or archival purposes. The Participant waives any rights to compensation for the use of such media.
If the Participant does not consent to being photographed or recorded, they must inform the Event Organisers in writing prior to the Event.

7. LEGAL AGE & CAPACITY

The Participant confirms that they are 18 years of age or older or have obtained the written consent of a parent or legal guardian to attend the Event.

8. GOVERNING LAW

This Waiver shall be governed by and interpreted in accordance with the laws of Queensland, Australia, and any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

9. AGREEMENT & SIGNATURE

By signing below, the Participant acknowledges that they have read, understood, and voluntarily agree to the terms of this Waiver. The Participant further affirms that they are legally competent to sign this document and understand that this Waiver limits their legal rights.
